These Terms of Service (“Terms”) govern your access to and use of the Seven Rubies website, platform, and related services (collectively, the “Services”), operated by Seven Rubies (“Seven Rubies,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Description of the Services
Seven Rubies is an online directory and marketing platform that allows professional boudoir photographers (“Vendors”) to subscribe for a listing within designated geographic markets (DMA regions). The Services function solely as a neutral venue for discovery and do not provide photography services directly.
Seven Rubies does not employ, endorse, guarantee, or supervise Vendors.
2. Eligibility
You must be at least eighteen (18) years old and capable of entering into a legally binding contract to use the Services.
If you are using the Services on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
3. Vendor Accounts and Listings
Vendors are responsible for:
- Providing accurate and current business information
- Maintaining required professional licenses, permits, and insurance
- Ensuring all content submitted complies with these Terms
Listings are non-transferable and limited to the DMA(s) purchased or assigned.
Seven Rubies reserves the right to approve, reject, suspend, or remove any listing at its sole discretion.
4. Content Submitted by Vendors
“Submitted Content” includes photographs, text, logos, videos, and any other materials uploaded or displayed through the Services.
By submitting content, you represent and warrant that:
- You own the content or have all necessary rights and licenses to use it
- All individuals depicted are at least 18 years of age
- You have obtained valid, written model releases permitting:
- Commercial display
- Online publication
- Advertising and promotional use
- The content does not violate any law, regulation, or third-party right
5. Copyright and Intellectual Property
5.1 Vendor Content Ownership
Vendors retain ownership of their Submitted Content.
5.2 License to Seven Rubies
By submitting content, you grant Seven Rubies a non-exclusive, royalty-free, worldwide, sublicensable license to:
- Display, host, store, and distribute the content
- Use the content in marketing, promotion, and platform operations
- Resize, crop, or format content for technical or design purposes
This license survives removal of content to the extent necessary for archival, promotional, or legal purposes.
6. Model Privacy and Releases
Vendors are solely responsible for safeguarding the privacy and dignity of individuals depicted in Submitted Content.
You agree that:
- No identifying personal information (real names, contact details, medical information) of models may be published without explicit consent
- Seven Rubies has no obligation to verify releases but may request proof at any time
- Failure to provide valid releases upon request constitutes a material breach of these Terms
7. Prohibited Content – Nudity & Explicit Material
Seven Rubies maintains a strict no-nudity policy.
The following content is not permitted, even in artistic or implied form:
- Visible genitalia or anus
- Explicit sexual acts or simulations
- Pornographic or sexually graphic content
- Content intended to arouse sexual interest rather than showcase photography style
Seven Rubies reserves the right to:
- Remove content without notice
- Blur, crop, or suppress images
- Suspend or terminate accounts for violations
Determinations are made at Seven Rubies’ sole discretion.
8. Content Moderation
Seven Rubies may, but is not obligated to:
- Review Submitted Content
- Remove or restrict content that violates these Terms
- Suspend or terminate access for repeated or serious violations
Seven Rubies is not a publisher of Vendor content and assumes no liability for it.
9. DMCA Copyright Policy
Seven Rubies respects intellectual property rights and responds to valid DMCA takedown notices.
To submit a copyright complaint, please provide:
- Your signature
- Identification of the copyrighted work
- Identification of the allegedly infringing content
- Contact information
- A good-faith statement
- A statement under penalty of perjury

10. Payments and Subscriptions
Vendor subscriptions are billed according to the pricing and terms presented at purchase.
Unless required by law or explicitly stated in writing:
- All fees are non-refundable
- Failure to pay may result in suspension or termination
- Pricing and features may change with notice
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
SEVEN RUBIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Seven Rubies does not guarantee:
- Leads or bookings
- Listing visibility or ranking
- Business outcomes
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEVEN RUBIES SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS OR BUSINESS OPPORTUNITIES
- CONTENT SUBMITTED BY USERS
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SEVEN RUBIES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Seven Rubies from any claims arising out of:
- Your Submitted Content
- Lack of model releases
- Privacy violations
- Copyright infringement
- Violation of these Terms
14. Termination
Seven Rubies may suspend or terminate your access at any time, with or without notice, for any reason.
Upon termination:
- Licenses granted to Seven Rubies survive as stated
- No refunds are owed
15. Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.
16. Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.

No mobile information will be shared with third parties/affiliates for their own marketing or promotional purposes.

Your participation in the SMS Program is also subject to our Privacy Policy.
